Certain Height Limits on the Rise in Surf City

Reaching new heights – that’s what a move by the Surf City Borough Council last week will allow homeowners and builders when it pertains to chimneys, railings and temporary decorative ornaments.

The council unanimously approved ordinance 2017-08, amending a revised general ordinance that pertains to zoning. The amended ordinance deals specifically with Section 30-6.4, titled building area and dimensions, and section 30.7.4, also titled building area and dimensions.

“The following may exceed the height limitations herein established: chimneys, railings, and temporary decorative ornaments, including but not limited to weather vanes,” the amended ordinance reads. All ordinances or parts of ordinances inconsistent with the amended measure are repealed, according to the new law. “If any word, phrase, clause, section or provision of this ordinance shall be found by any Court of competent jurisdiction to be unenforceable, illegal, or unconstitutional, such word, phrase, clause, section or provision shall be severable from the balance of the ordinance and the remainder of the ordinance shall remain in full force and effect.”
