Man Found Guilty of Sexual Assault

On June 20, a jury returned a verdict of guilty to one count of second degree sexual assault against Alan D. Harbatuk, 71, formerly of Hillsborough. Harbatuk was convicted of engaging in sexual relations with a 15-year old in 2003 both in Barnegat Township at the Joseph A. Scout Citta Reservation camp and in Hillsborough Township, Somerset County, where Harbatuk resided at the time.

Immediately following the verdict, Harbatuk was remanded to the Ocean County Jail pending sentencing, which will be scheduled once an evaluation at the Adult Diagnostic and Treatment Center is completed. Harbatuk faces five to 10 years in New Jersey state prison with Megan’s Law required registration and parole supervision for life.

Harbatuk was arrested on Oct. 23, 2014 by the Somerset County Prosecutor’s Office. His charges stem from conduct in Hillsborough Township as well as Barnegat Township. The case was subsequently transferred to the Ocean County Prosecutor’s Office to be prosecuted together with co-defendant Raymond Waters. Waters was charged with aggravated sexual assault and sexual assault for engaging in sexual relations with the same victim while a teacher at Toms River North High School. Waters’ trial will be held at a future date.

The case was tried by Senior Assistant Prosecutor Kristin L. Pressman before the Honorable Therese A. Cunningham, J.S.C. Investigators included Sgt. Jason Steele of the Ocean County Prosecutor’s Office, Somerset County Prosecutor’s Office Detective Justin Berger and Hillsborough Police Department Detective Robert Meszaros, as well as Detective Tom Grosse and retired Detective Alex Scherer of the Toms River Police Department.
